Jason P. Capizzi, Esq. is a well-recognized government and public finance attorney in New Jersey. Mr. Capizzi primarily focuses his law practice on providing Bond Counsel services to issuers of municipal securities throughout New Jersey (including counties, county improvement authorities, municipalities, school boards, local and regional sewerage authorities, and municipal utility authorities), and as Trustee’s Counsel and Underwriter’s Counsel to financial institutions participating in public finance transactions as well.
Mr. Capizzi regularly represents governmental entities in matters involving the Local Finance Board and the Division of Local Government Services in the Department of Community Affairs, and the New Jersey Infrastructure Bank; in addition to matters involving the Internal Revenue Service and the Securities and Exchange Commission. Mr. Capizzi’s notable public finance transactions include having served as Defeasance Counsel for the Borough of East Rutherford with respect to the $2 billion American Dream project financing in 2017.
In addition to his public finance law practice, Mr. Capizzi serves as General Counsel to select governmental and private entities (including housing authorities, nonprofit housing corporations, and sewerage authorities), and as Special Litigation Counsel throughout New Jersey.
Mr. Capizzi began his legal career in the public sector as Assistant Counsel to New Jersey Governors James E. McGreevey and Richard J. Codey; and later returned to public service as Deputy Attorney General to the regulator of municipal finance in New Jersey, the Local Finance Board and the Division of Local Government Services in the Department of Community Affairs. Mr. Capizzi’s private sector experience led to the formation of Kraft & Capizzi, LLC in 2014, and his succession to the law practice of John L. Kraft, New Jersey’s first Bond Counsel.

In May 2017, Mr. Capizzi was installed as a member of the Fellows of the American Bar Foundation after having been nominated by its New Jersey membership. The Fellows is an honorary organization of attorneys, judges and legal scholars whose professional, public and private careers demonstrate outstanding dedication to the welfare of their communities and to the highest principles of the legal profession. Established in 1955, the Fellows comprise less than 1% of the lawyers licensed in each jurisdiction and count the following New Jersey lawyers among its national membership: United States Supreme Court Justice Samuel A. Alito, Jr.; New Jersey Governors Christopher J. Christie and Brendan T. Byrne; New Jersey Supreme Court Chief Justice Stuart Rabner and Justice Jaynee LaVecchia; and former Secretary of the U.S. Department of Homeland Security, Michael Chertoff.
In September 2016, Mr. Capizzi was 1 of 24 individuals selected by The Bond Buyer to receive its inaugural Rising Stars in the Municipal Finance Industry Award. Of the honorees, Mr. Capizzi was 1 of 5 attorneys nationwide, and the only public finance professional from New Jersey, to be recognized.
In March 2016, 2017 and 2018, Mr. Capizzi was selected by Thomson Reuters as a New Jersey Super Lawyers Rising Stars in Government Finance; and in 2019 Mr. Capizzi was selected by 201 Magazine as Bergen’s Top Lawyers in Public Finance.
In June 2015, Mr. Capizzi was selected by the New Jersey Law Journal as one of its 2015 New Leaders of the Bar.
Mr. Capizzi designed and taught an introductory public finance class for the Rutgers University Center for Government Studies School of Continuing Studies. Mr. Capizzi also served as a member of the faculty in the Department of Human Ecology at Rutgers University, having taught Introduction to Human Ecology from 2012 – 2017.
